The offer and sale of products through the Filicori Zecchini site of Filicori Zecchini USA Corp are governed by the General Sales Term illustrated below.
PARTIES TO THE CONTRACT
The following are to be considered parties to the contract: Filicori Zecchini USA Corp, with headquarters in 399 Main Street, Lodi New Jersey 07644, United States (hereinafter referred to as "Filicori Zecchini"); and the subject (natural person, company or other legal entity - hereinafter referred to as "Customer") who, registered on the site http://www.filicorizecchini.com, concluded an order that has been accepted by Filicori Zecchini.
APPLICATION AND MODIFICATION OF THE GENERAL SALES TERM
By placing the order in the provided way, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the General Sales Term. Filicori Zecchini reserves the right to change the General Sales Term by giving notice on this page of the site.
The applicable General Sales Term are those in force at the time the order is placed. Any changes will be effective after publication on the site.
FEATURES AND PRICES OF PRODUCTS OR SERVICES
The images of the products may not be perfectly representative of their characteristics but differ in color, size, accessories.
All purchase support information is intended as a simple generic information material, not referable to the real characteristics of a single product.
The products are offered at the price indicated on the site on the date the order is placed.
The prices are not inclusive of sales taxes which will be indicated in detail in the invoice for the purchase of the product.
The prices do not include transport and delivery costs which are in any case indicated in the final section before sending the order and specified in the order receipt confirmation sent by e-mail to the Customer.
PLACEMENT OF ORDERS
Orders can be placed from and to the following territories: United States of America.
Orders are subject to minimum or maximum quantity limitations and the products are offered within the limits of stock availability.
Orders from individuals who have not reached the age of majority will not be accepted. The steps for placing the order and concluding the purchase contract are clearly highlighted in the sequence of pages of the site through explanatory texts and graphics.
In particular, it is advisable to read the information on withdrawal which can be printed at any time.
It is possible to correct any data entry errors before sending the order.
CONFIRMATION OF THE RECEIPT OF THE ORDER AND ACCEPTANCE OF THE SAME
Received an order, Filicori Zecchini will automatically send a confirmation of receipt by e-mail, in which all the details of the order will be summarized.
Following the receipt of an order, Filicori Zecchini will verify the actual availability of the ordered product and will communicate its acceptance of the order and the shipment of the product only after the positive outcome of this verification.
In the event that Filicori Zecchini is unable to fulfill an order received, it will promptly notify the customer.
Any right of the customer to compensation for damages is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things caused by the non-acceptance of an order.
PAYMENT METHODS ACCEPTED
Filicori Zecchini accepts payments only through the systems indicated below in the pages of the filicorizecchini.com site.
SHIPPING OF PRODUCTS
Product shipments and deliveries can only be made in the territories of the United States of America.
Filicori Zecchini will ship the purchased products exclusively to the destination address specified in the order.
We do not accept shipments to post office boxes.
Filicori Zecchini will ship the products ordered by the customer, by courier, to the address indicated by the same, approximately within 3 (three) working days from the acceptance of the order.
Delivery generally takes place within 5 working days.
The times indicated for the receipt of the goods are indicative.
Delivery costs are invoiced on the basis of the rates indicated on the site on the date the order was sent.
The recipient of the goods is responsible for paying the taxes and customs duties provided for by the legislation in force in the territory of destination of the products.
The courier is responsible for the delivery.
Upon delivery of the Products to the applicable carrier, the risk of loss or damage shifts to the Customer. Delivery is deemed complete and title to the Products passes to the Customer upon acceptance of the shipment by a common carrier.
Filicori Zecchini undertakes to collect any reports of non-delivery or delayed delivery of the products through the Customer Service and, if necessary, to assist the customer in protecting their rights as required by law.
ACCEPTANCE OF THE PRODUCT BY THE CUSTOMER
Any damage to the packaging and / or the product or the mismatch in the number of packages or information must be immediately notified by placing a specific indication on the delivery document.
By signing the courier's document, the customer certifies the external integrity of the product and the conformity of the delivery.
Any problems relating to the physical integrity, correspondence or completeness of the products received must be reported within 7 working days of delivery by sending an email to the address firstname.lastname@example.org
Filicori Zecchini will issue an order/payment confirmation for each order placed by the Customer. Invoices are issued only upon specific request of the Customer. For the issuance of the invoice Filicori Zecchini will use the information provided by the Customer at the time of registration or at the time of an order, providing for the option of indicating addresses other than those indicated for shipping. No variation of the data indicated in the invoice will be possible after the issuance of the same.
The Customer may exercise, within thirty (30) days from the date of delivery, the right to return the Products and receive a refund of the amount paid (including delivery costs, where applicable), by calling Customer Care.
Once the Customer has communicated his/her intention to return the Products as described above, the Customer Care team will contact the Customer in order to agree on the method of return and to send the form to be filled in by the Customer. The Customer will then be contacted directly by the courier, via e mail or at the phone number provided to Filicori Zecchini at the time the order was placed, in order to agree on the date of taking charge of the return. The delivery of the goods to the courier must take place within thirty (30) days from the date on which the Customer has communicated his/her intention to return the Products.
The shipping costs for the delivery of the returned goods will be charged to the Customer, who will then be refunded through the same method used by the Customer to make the payment.
Returns shall only be accepted only if all of the following conditions are met:
a. The Product(s) have not been used, are not damaged and are in the same conditions in which they were received by the Customer; and
b. The Product(s) are returned in their original packaging, including any seals, all labels, and any documentation included in the original package.
Once Filicori Zecchini determines that the return conditions set forth herein have been met, Filicori Zecchini will refund the Customer within 14 (fourteen) days following the Filicori Zecchini's receipt of the Products, using the same payment method used to make the original purchase on the Website. If you paid by credit card or debit card, refund times will depend on the credit or debit card company’s policies. The Customer will be refunded the price paid for the Products and shipping costs.
We will not issue any refunds for returns that do not satisfy all of the return conditions, and we will send you an email to inform you that the return was not accepted. Within [fifteen (15) days] after receipt of such email, the Customer may ask that the Products be shipped back to him/her, at Customer’s own cost, in the condition in which they were received by Filicori Zecchini. If the Customer does not request the return of the Products within said time period, the Customer authorizes Filicori Zecchini, and any of its affiliates or agents, to retain the Products and the price paid, and to dispose of such Products as it sees fit.
FOOD PRODUCTS MAY NOT BE RETURNED IN ANY CASE.
Filicori Zecchini warrants that the products purchased on the site filicorizecchini.com will be free from any defects for a period of time of 12 (twelve) months starting from the date of the Order confirmed by Filicori Zecchini (“Warranty Period”).
TO THE EXTENT NOT PROHIBITED BY LAW, WE LIMIT THE DURATION AND REMEDIES OF ANY WARRANTIES TO THE WARRANTY PERIOD. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
THIS LIMITED WARRANTY ONLY EXTENDS TO THE ORIGINAL PURCHASER OF PRODUCTS FROM THE SITE. IT DOES NOT EXTEND TO ANY SUBSEQUENT OR OTHER OWNER OR TRANSFEREE OF THE PRODUCT. THIS LIMITED WARRANTY DOES NOT COVER ANY DAMAGES DUE TO 1) TRANSPORTATION; 2) STORAGE; 3) IMPROPER OR NEGLIGENT USE; 4) FAILURE TO FOLLOW PRODUCT INSTRUCTIONS; 5) MODIFICATIONS; 6) COMBINATION OR USE WITH ANY PRODUCTS, MATERIALS, PROCESSES, SYSTEMS OR OTHER MATTER NOT PROVIDED OR AUTHORIZED IN WRITING BY FILICORI ZECCHINI; 7) UNAUTHORIZED REPAIR; 8) NORMAL WEAR AND TEAR; OR 9) EXTERNAL CAUSES SUCH AS ACCIDENTS, ABUSE, OR OTHER ACTIONS OR EVENTS BEYOND OUR REASONABLE CONTROL.
THE WARRANTY PERIOD IS NOT EXTENDABLE EVEN IF WE REPAIR OR REPLACE A WARRANTED PRODUCT. WE MAY CHANGE THE AVAILABILITY OF THIS LIMITED WARRANTY AT OUR DISCRETION, BUT CHANGES WILL NOT BE RETROACTIVE.
TO OBTAIN THE WARRANTY: YOU MUST SEND THE WARRANTED PRODUCT ALONG WITH ALL DOCUMENTS PROVING THE PURCHASE AND THE DELIVERY DATE TO OUR ASSISTANCE CENTER:

AS OUR SOLE LIABILITY UNDER THE LIMITED WARRANTY, AND YOUR SOLE AND EXCLUSIVE REMEDY, WE WILL, IN OUR SOLE DISCRETION, EITHER REPAIR OR REPLACE THE WARRANTED PRODUCT OR ITS DEFECTIVE PART OR REFUND THE PURCHASE PRICE OF SUCH PRODUCTS. WE WILL ALSO PAY FOR SHIPPING AND HANDLING FEES TO RETURN THE REPAIRED OR REPLACEMENT PRODUCT OR PART TO YOU IF WE ELECT TO REPAIR OR REPLACE THE DEFECTIVE PRODUCT OR PART.
FILICORI ZECCHINI DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
LIMITATION OF LIABILITY
THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE OBLIGATION AND LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY WILL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT THAT YOU HAVE PURCHASED THROUGH THE SITE, NOR WILL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY LOSS OF PRODUCTION, WORK, DATA, USE, BUSINESS, GOODWILL, REPUTATION, REVENUE OR PROFIT, ANY DIMINUTION IN VALUE, COSTS OF REPLACEMENT GOODS, OR CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT, OR FOR ANY LOST PROFITS, INCOME OR REVENUE.
